Terms & Conditions (booking a course with MiSP)

Please read carefully and print or save a copy of this agreement between you and MiSP for future reference. By applying for a MiSP course you are confirming that you fulfil the specific course pre-requisites and that you agree to be bound by the following terms and conditions:

1. Course application

1.1 Course applications should be made via our website: mindfulnessinschools.org

1.2 Once you have applied, you will receive an automated email confirming that MiSP has received your application and strictly subject to meeting the course prerequisites, you will be sent an offer letter and an invoice.

1.3 A legally binding agreement shall not come into existence until MiSP has offered you a place on the course by:

(i) Notifying you by email in an offer letter that you have been accepted on the course and;

(ii) Confirming the receipt of payment in cleared funds from yourself or your employer, if applicable.

1.4 MiSP reserves the right to reject any course applications but will always endeavor to provide an explanation where this occurs.

2. Course requirements

2.1 You must meet the specific pre-requisites as defined for each MiSP training course. In addition if the course if being delivered ONLINE you must:
(i) Be able to commit to the dates and times of all the online sessions;
(ii) Have access to a computer or laptop with a webcam, have good broadband, and be capable of running Zoom – click here to check technical requirements.

2.2 You must be at least 18 years of age to attend any MiSP training course.

2.3 In order to attend any MiSP training course, you must be able to speak and read English to an Upper Intermediate Level, i.e. be able to interact fluently with native speakers, communicate effectively and understand everyday language. You should not require simultaneous translation during any part of the course itself. MiSP reserves the right to withhold certification if this is not the case.

2.4 For all courses delivered locally (rather than online) you must ensure that you have a valid visa and can comply with all immigration requirements before booking a course. Any travel costs and other expenses are entirely the course applicant’s responsibility.

2.5 You are expected to participate actively in the MiSP training course and to behave professionally, respectfully and politely throughout.

2.6 If you have any specific needs, you advise us at the earliest possible time by emailing support@mindfulnessinschools.org so that we can contact you to discuss your requirements.

2.6 MiSP reserves to right to reject any course application, to withhold course certification or to ask a participant to leave a course at any time if course participants are not able to provide sufficient evidence that course requirements have been met.

3. Payment

3.1  The course fee will be displayed on the course application form and the invoice. Details of how to pay will be displayed on the invoice.

3.2 Payment is required in full to secure your place on the course:

(i) Payment may be made by BACs transfer or cheque.

(ii) Any payment made to MiSP will be for the invoiced sterling amount with all currency exchange costs or bank fees borne by the payer.

4. Joining Instructions

4.1 Joining instructions will be sent out by email prior to commencement of the course.

4.2 Please contact support@mindfulnessinschools.org if you have any queries arising on receipt of the joining instructions.

5. Cancellation, refund and deferral policy

5.1 Should you wish to cancel your place on a MiSP training course, you must inform MiSP of your decision by email to finance@mindfulnessinschools.org as soon as you are able.

5.2 If you cancel your place on the course up to 30 days prior to the course start date you will be offered:

(i) A refund of 80% of the course fee

OR

(ii) A transfer to another course within one year. A transferred place can only be transferred once and no refund will be possible if the transferred place is subsequently cancelled.

5.3 If you cancel your place on the course within 30 days of the course start date, please note that:

(i) No refund is possible unless (see exceptions in 5.3ii)

(ii) If the cancellation is due to ill health and is certified by a doctor’s certificate or certain exceptional circumstances then MiSP has the discretion to transfer the place to another course within one year (if availability allows) subject to payment of additional administration fee of £85 + VAT to cover a portion of MiSP’s non-recoverable costs on the first course. A transferred place can only be transferred once and no refund will be possible if the transferred place is subsequently cancelled.

5.4 Full attendance at all sessions of the course is required. MiSP will not issue a certificate of training nor give access to online teaching materials if you leave the course early.

5.5 In some cases unavoidable situations might occur resulting in a participant missing part of a training course, e.g. serious injury or a family member being taken ill, the decision as to whether or not the participant is then allowed to continue with the course will be at MiSP’s discretion.

5.6 If a large section of the course is missed, the participant will be asked to attend the equivalent sessions in question on a future training course and will incur an additional fee.

5.7 MiSP reserves the right to cancel a course up to 30 days prior to the commencement of the course. If MiSP cancels a course you will be offered your choice of a place on another course or a full refund.

5.8 MiSP shall not be liable to refund any other expenses incurred by the participant.

5.9 MiSP shall not be liable to refund fees or any other expenses incurred by the participant should courses be cancelled due to circumstances beyond our control.

6. Intellectual property

6.1 At all times, MiSP will retain ownership of the intellectual property contained within the courses and the accompanying course materials. You may not modify, adapt, copy, reproduce, re-publish, translate, make available, disseminate or distribute in anyway any of the materials provided on the course and made available online via the MiSP Trained Teacher Hub. No course or course materials, nor any part thereof may be reproduced, stored, shared or transmitted in any form or by any means without the prior written permission of MiSP.

6.2 You may seek permission in writing from MiSP to translate the materials for your own personal teaching and on acceptance of the terms and conditions laid out in MiSP’s Translation Agreement. Permission to undertake translation of any of MiSP’s materials may only take place where a formal Translation Agreement is in place.

7. Data protection

7.1 Personal information collected and/or processed by us will be used for the purposes set out in our Privacy Notice. A copy of our privacy notice can be found on our website. This notice explains what information we collect, why we collect it and what we do with it. We are legally obliged to use your information in line with all applicable laws concerning the protection of personal information, including the General Data Protection Regulation 2016/679.

8. General

8.1 MiSP has the right to update or amend these Terms and Conditions from time to time.

8.2 By attending a MiSP course you agree to allow MiSP use of photographs and video footage taken of you during MiSP training in publications, press articles, promotional material and on the website. If you wish to opt out of this, you can do so by emailing support@mindfulnessinschools.org

8.3 If you have symptoms of physical or mental ill health, it is your responsibility to consult your doctor and/or other healthcare professionals and follow their advice.

8.4 MiSP curricula, and related Hub materials, are published in English. Translations into other languages are only available due to the efforts of volunteers and MiSP cannot guarantee their accuracy or availability. Participants planning to teach this curriculum in a language other than English should visit our Translations web page to see which versions are currently available and direct further queries by email to support@mindfulnessinschools.org
