Terms & Conditions (Teaching The Present for Schools course)

Please read carefully and print off a copy of this agreement between you and The Present Courses CIC (TPCCIC) for future reference. By applying and completing the The Present for Schools training course you are confirming your agreement to be bound by these terms and conditions.

Intellectual property

1.1 At all times, The Present Courses CIC remains the owner of the intellectual property of The Present for Schools course and the accompanying course materials. You may not modify, adapt, copy, reproduce, re-publish, translate, make available, disseminate or distribute in anyway any of the materials provided on the course and made available online via the Hub, other than as covered in 1.3.

1.2 No course or course materials, nor any part thereof may be reproduced or transmitted in any form or by any means without the prior written permission of The Present Courses CIC.

1.3 You may seek permission from The Present Courses CIC to translate the materials for your own personal teaching and on acceptance of the terms and conditions laid out in the TPCCIC Personal Translation Agreement.

The course content and teaching materials

2. Copyright of the course belongs to The Present Courses CIC.

2.1 Using the materials provided:

  1. i) Materials must not be copied or shared except for teaching by TPCCIC certified teachers.
  2. ii) Materials must not be amended without the specific permission of, and in collaboration with, The Present Courses CIC.

The Hub

2.2 The course includes six months complimentary membership of the MiSP Hub, from where all teaching materials can be downloaded, along with other resources. At the end of the six months, membership will be available for a tiered annual fee subject to circumstances.

You are still able to teach the course if you are not a member of the Hub but you will not have access to any new materials or any other updated resources in the Hub.

Your membership of the MiSP Hub is exclusively for you as a trained The Present for Schools teacher, and must not be shared with any other teachers, including those trained to teach the curriculum. This is the case even if your employer or someone else had paid for you to train to teach The Present or to have ongoing access to the Hub.

Teaching The Present for Schools course

3. In order to teach the curriculum you must have been granted a Certificate of Training from MiSP or an authorised partner, i.e. MiSP.

3.1 You will be acting as an independent teacher, any publicity materials should make it clear you are trained by or a partner of TPCCIC or MiSP and that you are not an employee of MiSP or TPCCIC.

3.2 It is your responsibility to organise the necessary insurance cover required to teach The Present for Schools course. You will not be covered by TPCCIC or MiSP’s insurance

3.3 The Present for Schools course involves training to teach the curriculum to pupils, but not to provide any form of teacher training for adults (i.e. training others to teach The Present for Schools course).

3.4 The simple key practices from the book can be used when demonstrating this work to adults. When doing so, we would request you mention that these are part of The Present for Schools curriculum.

3.5 The Present for Schools curriculum must not be taught as a public course i.e. freely advertised for any interested party to attend. Background knowledge of the pupils you teach is essential to ensuring their safety and wellbeing. Schools or educational organisations provide the necessary framework of policies and procedures to safeguard children in a way which a public course would not. 3.6 You would be acting as a self-employed teacher of The Present for Schools, so we are not in a position to instruct you on what to charge. Of course, it will vary from region to region and according to the size of group, type of school, etc, all we would ask is that the fee you charge is reasonable and affordable for all schools. This is key to the integrity of the work we do, and our aim to increase the accessibility and sustainability of mindfulness provision within schools.

3.7 This curriculum is primarily designed for delivery in a school classroom, please ask for advice if used in other ways ie tailored for particular situations or online delivery.

Marketing the The Present for Schools course

4. TPCCIC is the owner of the intellectual property of the The Present for Schools course and the accompanying course materials, please refer to clause 1.1.

4.1 You should make it clear in all publicity materials i.e. websites, flyers and on social media that although you have been trained by TPCCIC or MiSP or a partner of TPCCIC or MiSP.

4.2 A ‘Trained to Teach’ logo is available for use on your website and in publicity materials. This should not be modified or altered in any way.

The Present for Schools is a trademarked logo and cannot be used without prior written permission from TPCCIC, apart from The Present for Schools materials provided in the Hub.

4.3 In marketing and publicising The Present for Schools course, TPCCIC requests you acknowledge that all materials, including the publicity materials made available on the MiSP Hub, belong to The Present Courses CIC and link any information provided to our website or the course information page.

4.4 To ensure consistency and quality, TPCCIC and MiSP request you read the guidelines for marketing yourself and the course. Please click here to view these guidelines

4.5 Do not cut and paste images from the TPCCIC or MiSP websites, particularly those of children.

4.6 The domain name of your website must not include TPCCIC or MiSP or any wording to indicate you are working in association with The Present Courses CIC or Mindfulness in Schools Project.

Data protection

5. Personal information collected and/or processed by us will be used for the purposes set out in the Privacy notice and will be held in accordance with the provisions of the General Data Protection Regulation 2016/679.

General

6. TPCCIC and/or MiSP has the right to update or amend these Terms and Conditions from time to time. These terms and conditions are available on MiSP’s website.

6.1 I agree to allow TPCCIC and/or MiSP use of photographs and video footage taken of me during TPCCIC and/or MiSP training in publications, press articles, promotional material and on the website. If you prefer not to have photographs and video footage of you in this way, please contact MiSP via the email address below
