Please read carefully and print off a copy of this agreement between you and Mindfulness in Schools Project (MiSP) for future reference. By applying and completing the Teach dots training course you are confirming your agreement to be bound by these terms and conditions.
Intellectual property
1. At all times, MiSP remains the owner of the intellectual property of the dots course and the accompanying course materials. You may not modify, adapt, copy, reproduce, re-publish, translate, make available, disseminate or distribute in anyway any of the materials provided on the course and made available online via the MiSP Trained Teacher Hub other than as covered in clause 3.
2. No course or course materials, nor any part thereof may be reproduced, stored or transmitted in any form or by any means without the prior written permission of MiSP.
3. You may seek permission from MiSP to translate the materials for your own personal teaching and on acceptance of the terms and conditions laid out in MiSP’s Personal Translation Agreement.
The course content and teaching materials
4. Copyright of the course belongs to MiSP.
5. Using the materials provided:
5.1. Materials must not be copied or shared except by teachers trained and certified by MiSP to teach dots and their Nominated Assistants.
5.2. Materials must not be amended or adapted without the specific permission of, and in collaboration with, MiSP.
The Hub
6. The course includes six months’ complimentary membership of the MiSP Hub, from where all materials can be downloaded, along with other resources. At the end of the six months, membership will be available for a tiered annual fee subject to circumstances.
7. You are still able to teach the course if, after 6 months, you choose to no longer be a member of The Hub but you will not have access to any new materials or any other updated resources housed in The Hub.
8. Your membership of The Hub is exclusively for you as an individual trained dots teacher, and must not be shared with any other teachers, including those trained to teach the curriculum. This is the case even if your employer or someone else had paid for you to train to teach dots or to have ongoing access to The Hub.
Teaching the dots course
9. In order to teach the curriculum you must have been granted a Certificate of Training from MiSP or an authorised partner.
10. You will be acting as an independent teacher, and any publicity materials should make it clear you are trained by MiSP or a partner of MiSP, and that you are not an employee of MiSP.
11. It is your responsibility to organise the necessary insurance cover required to teach the dots course. You will not be covered by MiSP’s insurance.
12. The Teach dots course involves training to teach the curriculum to pupils, but not to provide any form of teacher training for adults. For the avoidance of doubt: you are not permitted to train others to teach the dots course.
13. You are, however, permitted to provide guidance to your Nominated Assistants to lead specific simple practices as outlined in your ‘How to Teach Dots’ booklet in the Hub. The Nominated Assistants are not permitted to teach any other parts of the dots curriculum without completing their own Teach dots course and being certified by MiSP to teach dots.
14. If demonstrating any of the practices or content of dots to colleagues to showcase dots, we request that you make clear that these are part of MiSP’s dots curriculum. Please also make it clear that they would need to follow the full training pathway with MiSP to deliver any practices or content themselves.
15. The dots curriculum must not be taught as a public course i.e. freely advertised for any interested party to attend. Background knowledge of the pupils you teach is essential to ensuring their safety and wellbeing. Schools or educational organisations provide the necessary framework of policies and procedures to safeguard children in a way which a public course would not. 16. If you teach dots as an independent visitor to a school, you are acting as a self-employed teacher and we are not in a position to advise you on what to charge. Of course, it will vary from region to region and according to the size of group, type of school/setting, etc, all we would ask is that the fee you charge is reasonable and affordable for all schools/settings. This is key to the integrity of the work we do, and our aim to increase the accessibility and sustainability of mindfulness provision within schools.
17. This curriculum is designed for delivery in a school or pre-school setting and is not suitable to be delivered online to children who are not in a ‘bricks and mortar’ classroom in a school or setting. This is due to both the ages of the children involved and also the nature of the dots materials, practices and activities. For the avoidance of doubt, we do not permit trained dots teachers to deliver this curriculum online to children.
Marketing the dots course
18. MiSP is the owner of the intellectual property of the dots course and the accompanying course materials, please refer to clause 1.
19. You should make it clear in all publicity materials i.e. websites, flyers and on social media that although you have been trained by MiSP or a partner of MiSP you are not an employee of MiSP.
20. A ‘Trained to Teach’ logo is available for use on your website and in publicity materials. This should not be modified or altered in any way.
21. MiSP and dots are trademarked logos and cannot be used without prior written permission from MiSP, apart from the use of dots materials provided in the Hub.
22. In marketing and publicising the dots course, MiSP requests you acknowledge that all materials, including the publicity materials made available in the Hub, belong to Mindfulness in Schools Project and link any information provided to our website www.mindfulnessinschools.org
23. To ensure consistency and quality, MiSP requests you read the guidelines for marketing yourself and the course. Please click here to view these guidelines.
24. Do not cut and paste images from the MiSP website, particularly those of children.
25. The domain name of your website must not include Paws b, .b, dotbe, dots, MiSP or any wording to indicate you are working in association with Mindfulness in Schools Project.
Data protection
26. Personal information collected and/or processed by us will be used for the purposes set out in the Privacy notice and will be held in accordance with the provisions of the Data Protection Act 2018.
General
27. MiSP has the right to update or amend these Terms and Conditions from time to time. These terms and conditions are available on MiSP’s website.
28. I agree to allow MiSP use of photographs and video footage taken of me during MiSP training in publications, press articles, promotional material and on the website. If you prefer not to have photographs and video footage of you in this way, please contact MiSP via the email address below.
